Need clarification on Error Handling example in the Protocol Specification

In the Specification > Lifecycle > Error Handling section, there is an example of initialization error

I am wondering when could such a message exist, because from what I understood from the Version Negotiation section:

1. Server MUST respond with a version (not an error)
2. Server picks its own supported version if it doesn't support the client's (not an error)
3. Client decides to disconnect if it doesn't support server's version (not the server, without any notification / message)

So is this example incorrect or am I missing something?
